United States government implemented the Dietary Supplement and Health Education Act (DSHEA). Under this act the government gave the responsibility of determining whether or not a dietary supplement is safe for consumption to the supplement manufacturers, which includes protein powders. As long as the dietary supplement in question was not introducing a new ingredient the FDA would not perform any testing of the product.
